    2023 saw a record number of False Claim Act settlements, with $1.8 billion related to matters involving the healthcare industry, including physician arrangements. The OIG and DOJ have become vigilant in pursuing physician arrangements that violate commercial reasonableness, Stark law, and anti-kickback statutes. Furthermore, most False Claim Act settlements resulted from a whistleblower previously employed by the health system. This session will review and analyze recent DOJ False Claims Act recoveries that were directly related to physician compensation arrangements and demonstrate how provider recruitment professionals can lead their organization to a stronger and more streamlined provider contracting structure that informs and engages senior leadership, compliance, and legal.
